AI and the Truth. Various arts and media are becoming overrun with AI generated content. Some are so good that it is becoming difficult to discern the validity.
What are your thoughts on legislation that would require AI generated material to be watermarked and tagged as such by AI content creators? Legislation that would require platforms like YouTube, Facebook, Tiktok, etc. to make these labels visible to users?

Should there be penalties for distributing material without tags and watermarks for platforms (Facebook, TikTok, YouTube, etc.)?

The goal is not to stiffle art, creativity, or free speech. The goal is to provided notification that the material is just that. Art and/or opinion.

For example: Almost all movies have statements in the credits stating that it is fictional and any resembalance to real people and events is strictly coincidence.

There technically are in intellectual property law in the USA.  The reasons any AI model may have done a good job in making any “art” that is not uncanny valley like is because of the actual artists work these companies basically stole all human expression from the internet....

What are your thoughts on the future of AI and IP Law from an economic perspective? For example, the fair use doctrine protects freedom of expression by allowing a person to use a copyrighted work without permission in certain circumstances (e.g., parody, news reporting)....

IP is a boomer concept in the age of abundance. This is a hot take that really has me thinking.

I generally feel negatively toward Kyle for a myriad of reasons, but this is a really interesting proposal.

I’m still noodling on it. Thought I’d share so others can join me in the noodling.

Love this list, thanks. Do you have any ideas, or have you seen any, of what a reformed IP law might look like? I know at least one category theorist who was working on credit assignment / the misallocation of value problem....

I prefer to think of IP law as a system designed to incentivise the creation and dissemination of works that are valuable to others. I've never been comfortable with the framing that its primary function is to grant authors or inventors “moral rights” over their work, as though...
